These terms and conditions supersede any previously agreed.
By the exchange of monies, you are confirming that you will adhere to the Terms and Conditions below.
Payment
A non refundable booking fee is required to secure your date and until this has been paid, your date is not confirmed. Dates are allocated on a strictly first come, first serve basis
A telephone, video or face to face consultation will be offered a minimum of 10 weeks prior to your wedding. At that time the final design, cake flavours etc will be agreed. Your final invoice will be raised taking into account material/ingredient costs at that time
Your balance is due 6 weeks prior to your wedding. Any changes made after that time may incur additional charges. Please note that during the 6 weeks leading up to your wedding, all material and ingredients will be purchased and preparation work will commence
Cakes not paid for 28 days before the wedding may result in the contract being terminated and the loss of your booking fee
Should you cancel your wedding for any reason up to 6 weeks prior to your date, your booking fee will not be refunded. Should you cancel during the 6 weeks leading up to your wedding, you will be charged a proportion of the full cost and is dependent on how much work has been carried out
Should you cancel your wedding for any reason 2 weeks or less prior to your wedding, then you would not be entitled to a refund and your cake will be made
Should you require any non standard items for your wedding then these would need to be paid for in advance. In the event of a cancellation these items will be yours to dispose of as you wish
Fruit cakes need to be made at least 12 weeks in advance of your wedding. Payment for the fruit cake, marzipan and icing is required at that time. Should your wedding be cancelled for any reason whatsoever and the cake is made, it will be marzipanned and iced and the cake will be yours to dispose of as you wish. If you reschedule your wedding within the same year, the cake can used as long it hasn’t been marzipanned or if the marzipan is in date at the time required
Extreme Circumstances
If your wedding cannot go ahead due to Government legislation and you decide to cancel completely up to 6 weeks prior to your date, then your booking fee will be refunded less any costs incurred. This will include a charge for administration work plus any cake tastings, colour palette tests etc
In the event that your wedding is unable to go ahead due to Government legislation within the 6 weeks leading up to your wedding and your balance has been paid, you would be entitled to a refund less any costs incurred. The amount refunded depends on how much work had been carried out
If your wedding cannot go ahead due to Government legislation two weeks or less prior to your wedding, then you would not be entitled to a refund and your cake will be made
If your wedding is unable to go ahead due to Government legislation but you wish to move your wedding date, then your date can be moved free of charge. Your booking fee would then be moved to your new date. Should you move your date out more than two months then it will be necessary to requote based on current ingredient/material prices at the time of your new wedding date. If your preferred date is unavailable due to prior commitments, then the terms in point 1 above apply
Liability
In the unlikely event of a complaint, Karen’s Creative Cupcakes liability is limited to the maximum cost of your wedding cake
Karen’s Creative Cupcakes cannot be liable or responsible for any failure to perform, or delay in performance of any of its obligations under these terms that is caused by any act, event, non-happening, omission or accident beyond their reasonable control
Delivery/Collection
Karen’s Creative Cupcakes accepts no liability for cakes that are damaged after they have been delivered to the agreed location or collected. All cakes are photographed prior to leaving site
Please take care when displaying your wedding cake. Try to avoid positioning the cake in direct sunlight, under spot lights or near candles
The cost of delivery is be dependent on the distance to the venue from our premises
If collected, cakes should be transported on a flat surface (preferably in an empty boot). It is not recommended that cakes are put on a seat or a passenger knee. On hot days it is recommended that you travel with the air conditioning on or the windows open
Stand Hire
A range of stands are available to hire with wedding cake orders and are subject to availability
A hire charge of £15 to £100 per item will be made and is dependent on the style of stand required
A security deposit is also payable and is equal to the value of the item(s) hired. This will be refunded in full once the stand(s) are returned undamaged and in their original condition. Stands should be returned within 3 working days of the wedding unless other agreed
If the stand(s) are not returned within the time agreed, £10.00 per day/per item will be charged
Should the floor or table appear unstable and it is felt that that the cake could be damaged or there is a risk to guests then it is at the discretion of Karen’s Creative Cupcakes not use the stand
Food Intolerances
A full ingredient list will be supplied to the venue with your wedding cake. If required, this can be supplied sooner
Whilst no nuts are used as standard, some products state on their labels that they “may contain trace of nut”
Whilst all possible precautions are taken to avoid cross contamination, the environment in which they are made in is not totally gluten, dairy or nut free
Design and Decoration
Karen’s Creative Cupcakes reserves the right to make minor changes to best suit a design or if weather conditions make this necessary
Karen’s Creative Cupcakes will do its best to match any colour requests but cannot guarantee an exact match
Some cakes may be decorated with non-edible items or toppers. These should be removed prior to serving
Each cake is put on its own individual cake board. Stacked cakes will be supported by dowels and should be removed prior to serving
Should it be necessary to change the design, use additional boards, ribbon, make any repairs etc following payment of the balance invoice, a further charge may be made
Fresh Flowers
If real flowers/foliage are going to be used to decorate the cake, it is recommended that these come direct from your florist
Please note that some flowers are not suitable for use as cake decoration. Please ask your florist for details and advice on toxicity as Karen’s Creative Cupcakes cannot accept any liability that may arise from their use/misuse
If you have a specific design in mind it is recommended that you ask your florist to decorate the cake
If you require a simple design and the flowers/foliage are available when the cake is delivered, Karen’s Creative Cupcakes is able to decorate the cake. The flowers/foliage available will largely determine how this will be done
Karen’s Creative Cupcakes accepts no responsibility for the condition of the flowers/foliage used or any damage that may occur as a result of the florist decorating the cake
No responsibility is taken should anyone other than Karen’s Creative Cupcakes add any flowers/foliage to the cakes unless otherwise agreed in advance
Samples
Samples will be offered in the form of a mini cake - a cupcake, split in two with buttercream filling only and preserve (if required). A full list of cake flavours available upon request
Four samples are offered as standard and a charge £15.00 will be made if the cakes are collected. If posted, postage charges will apply.
